These Terms and Conditions (“Agreement”) form a legal contract between you (“you” or “User”) and Fundibora Limited. By accessing or using our website https://fundibora.com, mobile apps, or any services we provide (“Services”), you agree to be bound by this Agreement.

If you do not agree to these terms, do not use Fundibora.


2. Our Role

Fundibora is a digital platform that connects customers with independent service providers (“Fundis”). We do not provide services directly. We are not an employer or contractor of Fundis. We do not guarantee the quality, safety, or legality of the services Fundis offer.

3. User Eligibility

By using Fundibora, you confirm that:

  • You are at least 18 years old.

  • You have legal capacity to enter into this agreement.

  • Any account you create is in your name or under the legal authority of an organization.

4. User Accounts

To access certain features, you must create a Fundibora account. You agree to:

  • Provide accurate, current, and complete information.

  • Keep your login credentials secure.

  • Not allow others to use your account.

  • Accept responsibility for all activities under your account.

We reserve the right to suspend or terminate accounts for violations.

5. Rules of Use

When using Fundibora, you agree not to:

  • Violate laws or third-party rights.

  • Post false or misleading information.

  • Impersonate others or misrepresent affiliations.

  • Access Fundibora using automated systems (e.g., bots, crawlers).

  • Collect users’ data without consent.

  • Post reviews for your own listing or competitors.

  • Abuse promotions or create multiple accounts for bonuses.

6. Fundis (Service Providers)

Fundibora lists independent service providers (“Fundis”). By registering as a fundi, you agree to:

  • Only list services you are licensed and qualified to provide.

  • Be honest about your skills, pricing, and availability.

  • Deliver work with professionalism and integrity.

We may verify fundis through ID, documentation, interviews, or customer feedback. Fundibora reserves the right to suspend or remove fundis who receive complaints or violate standards.

7. Payments and Credits

  • Fundibora may charge listing or subscription fees, visible during purchase.

  • Some features (like accessing customer leads) may require purchasing credits.

  • Credits are valid for 12 months and are non-refundable, except in rare cases (e.g., invalid contact info).

  • Promotional credits must be used before expiry and cannot be exchanged for cash.

8. User Content

You may post reviews, ratings, or other content. You grant Fundibora a non-exclusive, royalty-free, worldwide license to use and display this content for marketing, improvement, or other purposes.

Fundibora may remove or modify content that violates these terms or our community standards.

9. Communications

By creating an account, you consent to receive SMS, email, or in-app notifications from Fundibora about your account, transactions, and promotions. You can opt out of promotional messages in your settings.

10. Intellectual Property

All Fundibora content (logos, software, designs, text, etc.) is our property or licensed to us. You may not copy, modify, or distribute our content without permission.

11. Disclaimers

  • Fundibora is not liable for services delivered by fundis.

  • We do not guarantee outcomes, nor do we warranty fundi work.

  • Use the platform at your own risk

12. Limitation of Liability

To the maximum extent permitted by law:

  • Fundibora’s total liability shall not exceed the amount paid by you (if any) in the 6 months prior to the claim.

  • We are not liable for indirect, incidental, or consequential damages, including loss of income or business.

13. Termination

Fundibora may suspend or terminate your account without notice if you violate this Agreement. All clauses that by nature survive termination (e.g., intellectual property, limitations, indemnities) will remain in effect.

14. Modifications

We may modify these Terms at any time. We will notify you of material changes via email or app. Continued use after changes means you accept the updated terms.

15. Governing Law

This Agreement is governed by the laws of Kenya. Any disputes shall be resolved in Kenyan courts.
